Copyright Policy

1. Canadian Notice-and-Notice regime
BorealHost.ai complies with the Canadian Notice-and-Notice regime established by the Copyright Modernization Act (2012). This regime differs from the American DMCA (Digital Millennium Copyright Act) and works as follows:
- The copyright holder sends a notice of alleged infringement to BorealHost.ai
- BorealHost.ai forwards the notice to the affected client as soon as possible
- The Canadian regime does NOT require automatic content removal (unlike the DMCA)
- The client is responsible for taking appropriate action in response to the notice
2. Obligations of BorealHost.ai
As a hosting service provider, BorealHost.ai commits to:
- Forward any notice of alleged copyright infringement to the affected client within a reasonable timeframe (generally 24 to 48 business hours)
- Retain records relating to notices received and forwarded for a minimum period of three (3) years. This log records the date and time each notice was received, its nature, the response provided and the date on which the notice is considered resolved. This period exceeds the six (6) month statutory minimum and meets the requirements of our infrastructure providers
- Not disclose the client's personal information to the copyright holder, except by court order
3. Notice content
To be valid, a notice of alleged copyright infringement must contain:
- The name and contact information of the copyright holder or their authorized representative
- The identification of the copyrighted work that is the subject of the alleged infringement
- The URL or description of the content in question
- A good faith statement indicating that the use of the content is not authorized by the copyright holder

5. Repeat violations
Although the Canadian Notice-and-Notice regime does not require automatic content removal, BorealHost.ai reserves the right to take additional measures in cases of repeat violations:
- After a first notice: forwarding the notice to the client and retaining records
- After repeated notices regarding the same content or client: formal warning to the client
- In case of persistent and documented violations: account suspension or termination in accordance with our Acceptable Use Policy
5.1 Repeat infringer policy
BorealHost.ai terminates, in appropriate circumstances, the account of any client or end user who is the subject of repeated and substantiated infringement notices. A client who has received three (3) distinct substantiated notices within a twelve (12) month period is deemed a repeat infringer and its account is terminated.
A client who itself hosts end users must adopt and enforce an equivalent policy in respect of them, terminate without delay the service of a repeat-infringing end user, and take reasonable measures to prevent that user from resuming use of its services. It must be able to demonstrate on request that it complies with this obligation.
5.2 Counter-notice
A client who considers a notice to be unfounded — in particular because it holds the required rights, because it benefits from a copyright exception, or because the content was misidentified — may send us a reasoned counter-notice at [email protected] within ten (10) days following receipt of the notice.
The counter-notice must identify the content at issue, set out the grounds relied on and provide the client's contact details. BorealHost.ai will forward the counter-notice to the complainant. Where the content at issue is manifestly unlawful or exposes BorealHost.ai or its infrastructure providers to a claim, BorealHost.ai may nonetheless require immediate removal of the content while the counter-notice is under review.
6. Client obligations
The client commits to:
- Not host content that violates third-party copyrights
- Respond in good faith to notices of alleged infringement forwarded by BorealHost.ai
- Promptly remove or modify any content for which a violation is confirmed
- Indemnify BorealHost.ai against any claims arising from copyright infringement by hosted content
7. AI-generated content
BorealHost.ai's artificial intelligence modules generate content from third-party models. The client is responsible for verifying that AI-generated content does not violate third-party copyrights before publishing it. BorealHost.ai does not guarantee that AI-generated content is free from any copyright infringement.
