Copyright Policy

1. Canadian Notice-and-Notice regime

BorealHost.ai complies with the Canadian Notice-and-Notice regime established by the Copyright Modernization Act (2012). This regime differs from the American DMCA (Digital Millennium Copyright Act) and works as follows:

  • The copyright holder sends a notice of alleged infringement to BorealHost.ai
  • BorealHost.ai forwards the notice to the affected client as soon as possible
  • The Canadian regime does NOT require automatic content removal (unlike the DMCA)
  • The client is responsible for taking appropriate action in response to the notice

2. Obligations of BorealHost.ai

As a hosting service provider, BorealHost.ai commits to:

  1. Forward any notice of alleged copyright infringement to the affected client within a reasonable timeframe (generally 24 to 48 business hours)
  2. Retain records of notices received and forwarded for a minimum period of 6 months, in accordance with the law
  3. Not disclose the client's personal information to the copyright holder, except by court order

3. Notice content

To be valid, a notice of alleged copyright infringement must contain:

  • The name and contact information of the copyright holder or their authorized representative
  • The identification of the copyrighted work that is the subject of the alleged infringement
  • The URL or description of the content in question
  • A good faith statement indicating that the use of the content is not authorized by the copyright holder

Notices of alleged copyright infringement should be sent to:

5. Repeat violations

Although the Canadian Notice-and-Notice regime does not require automatic content removal, BorealHost.ai reserves the right to take additional measures in cases of repeat violations:

  • After a first notice: forwarding the notice to the client and retaining records
  • After repeated notices regarding the same content or client: formal warning to the client
  • In case of persistent and documented violations: account suspension or termination in accordance with our Acceptable Use Policy

6. Client obligations

The client commits to:

  • Not host content that violates third-party copyrights
  • Respond in good faith to notices of alleged infringement forwarded by BorealHost.ai
  • Promptly remove or modify any content for which a violation is confirmed
  • Indemnify BorealHost.ai against any claims arising from copyright infringement by hosted content

7. AI-generated content

BorealHost.ai's artificial intelligence modules generate content from third-party models. The client is responsible for verifying that AI-generated content does not violate third-party copyrights before publishing it. BorealHost.ai does not guarantee that AI-generated content is free from any copyright infringement.
